THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.3080 OF 2018 ORDER:

This Civil Revision Petition is filed under Section 22 of the A.P. Buildings (Lease, Rent and Eviction) Control Act, 1960 assailing the orders dated 06.04.2018 passed in R.A.No.26 of 2015 on the file of the Chief Judge, City Small Causes Court, Hyderabad, wherein and whereby confirming the orders dated 12.12.2014 passed in R.C.No.228 of 2011 on the file of II Additional Rent Controller, City Small Causes Court, Hyderabad, allowing the petition filed by the respondent/landlord directing the petitioner/tenant to vacate the petition schedule property and handover the same within two (2) months.

At the time of arguments, learned counsel for the revision petitioner/tenant submitted that the petitioner is willing to vacate and handover the petition schedule property to the respondent/landlord within six (6) months. The petitioner filed an undertaking affidavit to that effect. He further submitted that the petitioner will pay the admitted rent till November, 2018. 3.

Learned counsel for the respondent/landlord submitted that four months time may be granted to the petitioner to vacate the petition schedule property.

In view of the submissions made by the learned counsel for both parties, this Court is not inclined to go into the merits of the main case.

Taking into consideration the nature of the business being carried on by the petitioner/tenant, this Court is inclined to grant five months time to the petitioner to vacate the petition schedule property.

In the result, the Civil Revision Petition is disposed of directing the petitioner/tenant to vacate the petition schedule property on or before 20.11.2018, subject to payment of admitted rent. If the petitioner/tenant fails to vacate the petition schedule property within the time stipulated above, the respondent/landlord is at liberty to take appropriate steps in accordance with law. There shall be no order as to costs.
