THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.12876 of 2013 ORDER:
In this Petition filed under Section 482 Cr.P.C., the petitioners/accused Nos. 2 to 5, seek quashment of the Proceedings in C.C.No.813 of 2010 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad.
The case of the petitioners is that petitioner Nos. 1 and 2/A.2 and A.3 are the parents, petitioner No.3/A.4 is the sister of Accused No.1, Petitioner No.4/A.5 is the husband of petitioner No.3/A.4. Accused No.1 is the husband of the de facto complainant. When the matter came up for hearing, learned counsel for petitioners informed that pending the petition, petitioner Nos. 1 and 2 (A.2 and A.3) were expired and now he is representing the petitioners 3 and 4 (A.4 and A.5) only. Learned counsel further submitted that he is confined to his prayer for dispensing with the presence of petitioner Nos.3 and 4 before the trial court as they are residents of Bangalore and therefore his prayer may be considered. Learned Public Prosecutor reported no objection. Having regard to the above submission, the presence of the petitioners Nos. 3 and 4 i.e., Accused Nos.4 and 5 is dispensed with in C.C.No. 813 of 2010 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad, except on the occasions when the trial Court specifically requires their presence.
Accordingly, this Criminal Petition is disposed of. Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
