Memo No.3680lAlA1l2O21 , dt. 24-6-2022 of the 1st respondent by rejecting the case of the petitioner for appointment under compassionate grounds without examining the any of the proposals forwarded by the respondents No.2 to 4 and simply rejected the case of the petitioner without any application of mind, the said action of the respondents is highly illegal arbitrary, unreasonable, discriminatory and also in violation of principles of natural justice and without any application of mind and also in violation of Art. 14, 16 and 21 of the Constitution of lndia and declare the same as bad-in-law and set aside the same and consequently direct

the respondents to consider the case the petitioner for appointment in any suitable post under compassionate grounds under provisions of Hindu Adoption and Maintenance Act '1956.

Learned counsel representing learned counsel for the petitioner submitted that after filing of the writ petition, the petitioner has been given compassionate appointment uide order dated 11.O9.2023 and therefore, the grievance of the petitioner does not exist any longer, seeks permission of this Court to withdraw the present Writ Petition.

Permission is accorded Accordingly, the Writ Petition is dismissed as withdrawn. There shall be no order as to costs Miscellaneous petitions, if any, pending in this Writ petition, shall stand closed.
