THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 16515 of 2011 ORDER:- Questioning the action of the 2nd respondent in cancelling the pattadar passbooks issued in favour of the petitioners in exercise of the power under Section 9 of the Andhra Pradesh Record of Rights and Pattadar Passbooks Act, 1971, and directing the 4th respondent to correct the village accounts duly making entries in the Prohibition Order Book in respect of the subject lands and take possession of the lands immediately, vide proceedings dated 21.04.2010 in Rc.F1/6587/2005, the present writ petition is filed.

At the time when the matter is taken up for admission, the learned counsel for the petitioners as well as the learned Government Pleader for Revenue appearing for the respondents 1 to 4 submitted that the subject matter of this writ petition is squarely covered by an order dated 16.12.2010 passed by this Court in W.P.No.11327 of 2010.

Accordingly, the Writ Petition is allowed by setting aside the impugned proceedings, with liberty to the 2nd respondent to initiate appropriate proceedings in accordance with the extant laws, after informing the petitioners of the grounds and the relevant provisions of the Acts, under which, he is seeking to proceed against them and after giving full opportunity of being heard to them. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
