HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.30424 of 2016 ORDER:

Vide the present petition, the petitioners seek a direction to respondent Nos.1 to 8 to restore possession of lands, admeasuring Ac.27.26 cents in Jillellagudem Village, Jeelugumilli Mandal, West Godavari District, or alternatively pay compensation with all rehabilitation benefits in the event of proposal for acquisition for Chintlapudi Lift Irrigation Scheme.

As stated by the learned counsel for the petitioners, petitioners made representation dated 23.07.2016 to respondent Nos.1 to 8. However, no communication has been received till date.

Learned Government Pleader for Land Acquisition, on advance notice, submits that, acquisition proceedings has not yet commenced as against the subject lands. Keeping in view the averments in the Writ Petition, and the submission of the learned Government Pleader for Land Acquisition, I find no cause of action in the present Writ Petition.

Therefore, Writ Petition is dismissed.

Needless to mention that, if any proceedings are initiated against the lands of the petitioners, the representation dated 23.07.2016 shall be taken into consideration. Moreover, the respondents shall grant

personal hearing to the petitioners, including the claimants concerned.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
