HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18509 OF 2018 O R D E R :

This petition is filed for the following relief; " .... to issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the official respondents in not registering the FIR on petitioner complaint dated 25.02.2018 is arbitrary, illegal, unconstitutional, in violation of Article 14, 19 and 21 of the Constitution of India, in violation of the Hon'ble Supreme Court Judgment of Lalith Kumari Vs. State of Uttar Pradesh (2014) 2 SCC 1 and consequently may direct the 4th respondent to register the FIR to conduct the enquiry and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of the petitioner dated 25.02.2018, against respondent Nos.5 and 6, which was entered into the Station General Diary, a preliminary enquiry was conducted; and that it is clearly revealed that no offence whatsoever was taken place as alleged in the complaint and the petitioner made false allegations. It is also stated that since the dispute of the petitioner as well as the persons named in his complaint is purely civil in nature, the respondents advised the petitioner to seek his redressal in a competent court of law. It is

further stated that the fact of result of the complaint filed by him was also informed to the petitioner and obtained acknowledgment from him.

Recording the aforesaid submission, the writ petition is disposed of. However, it is open for the petitioner to avail alternate remedy as may be available to him under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
