I.A.No.2 of 2018 is filed under Section 320(3) of the Code of Criminal Procedure, 1973 seeking leave of the Court, to permit both the parties to the petition to compound the offence, as the matter is settled outside the Court due to intervention of elders and it is submitted that A.1 and the de facto complainant are living together and leading marital life and that their compromise is voluntary. Both the parties appeared in person and they are identified by their respective counsel. They produced Photostat copies of Aadhar card in proof of their identity. When they were enquired about the compromise, A.1 and the de facto complainant represented that they are living together and leading marital life and that the compromise is voluntary.
Hence, the compromise is in the interest of both the parties and it is not against societal interest.
Therefore, I find that it is a fit case to grant leave to the petitioners to compound the offence.
Accordingly, I.A. No.2 of 2018 is allowed. Consequently, Crl.P.No.5682 of 2018 is allowed quashing the proceedings in C.C.No.2063 of 2018 on the file of XIV Metropolitan Magistrate, R.R. District, L.B. Nagar.
Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
