THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.6198 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioner/A1 seeking to relax the condition imposed vide order dated 18.09.2019 in C.C.No.712 of 2010, by the learned XXV Additional Metropolitan Magistrate, Cyberabad at Irbahimpatnam, directing him to handover the passport before the trial Court as there is every chance to escape from India.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the 1st respondent-State. 3.

Learned counsel for the petitioner submits that the petitioner is an Australian Citizen and his family is residing at Australia and that as the wife of petitioner is suffering from neurological problem, he has to take care of her. He also states that the trial of the case is completed and the case was posted for arguments and thus, he prays to relax the aforesaid condition imposed by the trial Court. 4.

Having regard to the facts and circumstances and since the case was posted for arguments, it would be appropriate to direct the trial Court to return the passport to the petitioner, for a period of 11⁄2 months, on condition of his furnishing an undertaking that he shall remain present personally, before the trial Court, on the date of pronouncement of the judgment.

With the above direction, the Criminal Petition is disposed of. 6.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
