Suresh Babu, learned counsel representing Sri K. Mahipathi Rao, for the appellants, would submit that the subject matter of the present Second Appeal was settled out of Court and as such, there is no need to adjudicate upon the controversy in the present Second Appeal and, therefore, seeks permission to withdraw the present Second Appeal.

2. Permission is granted.
