HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.11591 of 2011 ORDER :

The writ petition is filed to declare the action of the respondents in interfering with the petitioners' peaceful possession and enjoyment of house sites to an extent of 167 sq. yards each covered by Sy.No.113/3 situated at Yellapuvanipalem, Gopalapatnam, Visakhapatnam District, without following the procedure and without issuing any notice, as illegal and arbitrary.

2. On a representation that the learned counsel for the petitioners joined judicial service, the office was directed to issue notice to the petitioners. The note put up by the Registry shows that the notice sent to petitioner No.1 was returned unserved, while notice sent to petitioner No.3 is returned served and that the notice sent to petitioner No.2 is not yet returned served. Till date no Vakalat has been filed on behalf of the petitioners.

3. Today, when the matter is taken up for hearing, there is no representation for petitioner No.3 also. Learned Government Pleader for Revenue, on instructions, submitted that the respondents are not interfering with the possession of the petitioners.

4. In view of the afore-mentioned representation made by the learned Government Pleader for Revenue, no further orders are necessary in this writ petition and the

writ petition is to be closed.

5. Accordingly, this writ petition is closed. No costs.

6. Miscellaneous petitions pending, if any, shall stand closed.
