This Writ Petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in not providing option to upload caste certificate of the petitioner for consideration as OBC as illegal and arbitrary and consequently to direct the respondents 2 and 3 to consider the petitioner's OBC caste certificate for allotment of rank in JEE (Main)-2018 and JEE(Advance)-2018.

Heard learned counsel for the petitioner and Smt.

A.Chaya Devi, learned Standing Counsel for the respondents 2 & 3.

Smt.A.Chaya Devi, learned Standing Counsel for respondents 2 and 3 submits that the petitioner has wrongly mentioned as OC in the column meant for it and same cannot be corrected at this stage.

It is to be seen that when the petitioner made request for correction of caste as OBC, it was replied that though an opportunity was given for rectification of errors from 09.01.2018 to 22.01.2018, petitioner has not come forward and now there is no procedure for correction in any application form of JEE (Main)-2018. The petitioner has not utilized the said opportunity. That apart, petitioner has obtained caste certificate on 27.04.2018, i.e., much after the last date provided for correction. When once the respondents have given opportunity and informed

that there is no procedure for correction in application at this stage and petitioner could not explain why he has not utilized the opportunity, as such, there is no merit in the Writ Petition and no mandamus can be issued by exercising the power under Article 226 of the Constitution of India. In view of above facts and circumstances, I do not see any merit in the Writ Petition and same is liable to be dismissed.

Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ A.RAJASHEKER REDDY,J 05-06-2018 kvs
