THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5296 of 2016 ORDER:

Heard Sri V.V.N. Narasimham, learned counsel for the petitioner, and Sri S.D.Gowda, learned Standing Counsel for the Corporation.

The grievance of the petitioner is that the Kadapa Municipal Corporation is not taking steps to stop the construction activity of the unofficial respondents despite the orders in endorsement dated 03.02.2016 and the speaking order dated 09.02.2016 passed by the Corporation itself. However, the petitioner admittedly did not make any representation to the authorities in relation to the alleged inaction on the part of the Corporation after the passing of the aforestated orders. Without first approaching the Corporation canvassing its grievance as regards the alleged inaction in the light of the orders already passed by the Corporation, it is not open to the petitioner to come before this Court straightaway and complain of inaction.

The writ petition is therefore dismissed on this short ground. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
