O R D E R

The case of the petitioner, which is Public Health and Medical Employees' Union, represented by its General Secretary, is that the Government relaxed ban on transfers vide G.O.Ms.No.61, Finance (HRM -III) Department dated 24.05.2018, and as per Clause IV ( c ) of the said G.O., certain preferences are given to the office bearers of the recognized service associations / unions. The claim of the petitioner is that it is a recognized union and as per the said G.O., the office bearers are entitled for retention and that they are not to be transferred. Aggrieved by the action of the respondents in not extending the benefit of preferences to the office bearers of the petitioner - association in terms of G.O.Ms.No.61 dated 24.05.2018, the present writ petition is filed. Heard the learned counsel for the petitioner.

Learned Assistant Government Pleader for Medical and Health, appearing for respondents submit that petitioner is not a recognized union and hence the benefit of preferential treatment in transfers to its office bearers, cannot be extended and it is for the competent authority to consider the claim of the petitioner.

In view of the same, without expressing any opinion on merits, writ petition is disposed of at the stage of admission, directing the competent authority/ respondents, to consider the claim of the petitioner - Union, for extending the benefit as per Clause IV ( c ) of G.O.Ms.No.61 dated 24.05.2018 to its office bearers, provided it fulfils the conditions stipulated under the said G.O.
