HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5673 OF 2018 ORDER:
Heard learned counsel for petitioner-A.1 in crime No.80 of 2018 of Metpalli Police Station, Jagtial District, registered for the offences punishable under Sections 420, 417, 471 r/w 34 IPC and Sections 3 & 8 of A.P. Public Exam (Prevention of Malpractices and Unfair Means) Act, 1997, and the learned Public Prosecutor representing the State and perused the FIR, contents of the bail application and other material on record including the case diary.
A perusal of the case diary with reference to the FIR no way entitles to the concession of anticipatory bail to the petitioner. However, it is made clear that as none of the offences are punishable above seven years, the Police strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1. Accordingly and in the result, this Criminal Petition is disposed of.
