HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.21403 of 2019 ORDER:

Petitioner's grievance is that he had presented the deed of cancellation of registered G.P.A. dt.09-03-2015 for registration to the 3rd respondent and the 3rd respondent had kept it pending by giving Pending Doc.No.P/115/2019, and that it was the duty of the 3rd respondent to register the same.

Learned counsel for petitioner as well as counsel for learned Government Pleader for Revenue appearing for respondents agreed that the G.P.A. in question which is now sought to be cancelled did not create any interest in the Power of Attorney Holders and that Section 202 of the Indian Contract Act, 1872 would not be attracted. 3.

In a similar situation, this Court had held on 20-03-2019 in W.P.No.5765 of 2019 that there is no embargo against the unilateral revocation of such G.P.A.

In this view of the matter, the 3rd respondent is directed to register the said document and release it to the petitioner, if it is otherwise in order.

The Writ Petition is disposed of with the above directions. No costs.

MSR,J W.P.No.21403 of 2019 6.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
