THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.17942 of 2003 ORDER:

This writ petition is filed questioning award dated 20-05-2003 in I.D.No.23/2002 on the file of Industrial Tribunal-II, Hyderabad.

Petitioner herein was Conductor and on the allegation of reissuing tickets to the passengers and collecting money in a dishonest manner, he was removed from service after due enquiry. He referred the matter to the Industrial Tribunal and the Presiding Officer of the Industrial Tribunal-II, Hyderabad on a consideration of the material, upheld the removal order and held that the Corporation is justified in removing the petitioner in view of the dishonest

conduct.

3. When this matter has come up for consideration on 07-11-2015, there was no representation on behalf of the petitioner as the other side asked for time, it was adjourned by two weeks. From 03-12-2015, only on the request of Advocate for petitioner, it was adjourned to 09-12-2015 & 25-01-2016.

4. Today, though the matter is posted under the caption for 'final hearing', neither the Advocate for petitioner is present nor there any representation is made on behalf of the petitioner. In spite of accommodating the petitioner, no interest is evinced to prosecute the case.

5. Advocate for respondents present and submitted that the lower Court rightly considered the material on record and there are no grounds to interfere.

6. Considering these aspects, I am of the view that the petitioner is not interested in prosecuting the case and the same is liable to be dismissed for non-prosecution. No costs.

7. Accordingly, writ petition is dismissed for non-prosecution. No costs.

8. As a sequel, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
