Appellants 2 to 4 are present along with their learned counsel Sri Jithender Rao Veeramalla.

The respondent along with his counsel Sri Srinivas Polavarapu is present.

This appeal is filed by the sole appellant/plaintiff aggrieved by the judgment dated 21-1-2013 in A.S.No.291 of 2010 passed by the learned I Additional District Judge, Ranga Reddy District at L.B.Nagar, dismissing the plaintiff's suit O.S.No.41 of 2002. Pending the appeal, the sole appellant died and his L.Rs. came on record as appellants 2 to 4. The appellants 2 to 4 and respondent filed the present compromise petition.

As per the terms of compromise, respondent agreed to pay an amount of Rs.1,00,000/- (Rupees one lakh only) towards full and final settlement of suit claim to the appellants 2 to 4 by way of Pay Order No.078969 dated 17-7-2017 drawn on the United Bank of India for an amount of Rs.1,00,000/- (Rupees one lakh only). The said Pay Order is handed over to the appellants. Both parties agreed that in terms of compromise, this Second Appeal be dismissed without costs.

UDPR,J Samp_1922_2017 in sa_871_2013 sa_871_2013 In view of the above submission, this S.A.M.P.No.1922 of 2017 is allowed and consequently, this Second Appeal is dismissed without costs in terms of compromise.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
