HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.28767 of 2017 Order:

The petitioner states that she is a native and permanent resident of Guraja village of Mudinepalli Mandal, Krishna district. She along with her son is having agricultural lands in an extent of Ac.14.61 cents at Devaram village, Mudinepalli Mandal, Krishna district. The neighbouring farmers are also having Ac.25.16 cents in the same village. Since there was no feasibility to continue the agricultural operations, they wanted to convert their lands as fish tanks and applied to the third respondent seeking permission. The district level committee granted provisional permission for an extent of Ac.40.77 cents of land situated in various survey numbers by its order dated 04.07.2017 and now the present Writ Petition is filed alleging interference of the respondents with the digging operations of the petitioner.

Learned Government Pleader submits that there is no interference, in view of the provisional permission granted on 04.07.2017. In the circumstances, this Writ Petition is disposed of directing the respondents not to interfere with the digging operations of the petitioner in the land covered by the provisional permission so long as the petitioner confines her activities strictly in accordance with the provisional permission. If there is any violation, it is open to the respondents to take appropriate action in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
