HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.5657 of 2018 ORDER :
Since the case is withdrawn against the A.1 having been arrested and released on regular bail pending disposal of this anticipatory bail application and from the memo of police of no case made out against the A.3 and A.4, the present petition for anticipatory bail is now confined for A.2 only of Cr.No.227 of 2018 of Godhavari Khani I Town Police Station registered for the offences punishable u/ secs.406,417,420 and 323 IPC and u/ sec.3(1)® and (s) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) of the Amended Act(for short, 'the Act').
Heard the learned counsel for the petitioner and the learned Public Prosecutor and perused the material on record. No doubt from the very First Information report averments of the victim/ defacto-complainant there is no any public view of the intentional insult to attract Section 3(1)® and (s) of the Act. No doubt as pointed out by the learned Public Prosecutor for the offence under Section 323 IPC which is covered by the Schedule of IPC offences to attract Section 3(2)(va) of the Act, though otherwise the petitioner is entitled to the concession of bail.
Having regard to the above, the Criminal Petition is disposed of giving liberty to the A.2 to surrender before the learned Magistrate concerned and with an affidavit move for regular bail with a notice to the learned Public Prosecutor for the learned Special Judge to grant bail with necessary conditions preferably on the same day by virtue of this order.
Consequently, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
