HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 24095 of 2016 Order:

The case of the petitioner is that she is the wife of the second respondent herein whose marriage was performed on 08.03.1980 as per the Hindu Rites and Customs. After living together for a period of two years, some disputes arose between the petitioner and the second respondent. She left the company of the second respondent and after intervention of the elders and well wishers she rejoined the company of the second respondent. When there was no change in the attitude of the second respondent, she filed OP No.32 of 1986 on the file of the Sub-Court, Kothagudem, Khammam, seeking divorce. But the said petition was dismissed. Thus, the marriage between the petitioner and the second respondent is subsisting. She filed MC No.22 of 1986 on the file of II Judicial Magistrate of First Class, Khammam, and an order was passed on 17.03.

1989 granting maintenance to the petitioner. However, she learnt that the second respondent included the name of one Vasireddy Sujatha as his nominee instead of the petitioner. The petitioner submitted a representation on 07.06.2016 requesting to retain her name as nominee of the second respondent and she states that the same is pending with the first respondent. This Writ Petition is filed for disposal of the said representation.

2. In view of the innocuous relief sought in the present Writ Petition, the notice to the second respondent is dispensed with. However, this Writ Petition is disposed of directing the first respondent to consider the representation dated 07.06.2016 submitted by the petitioner and after hearing the petitioner and the second respondent pass appropriate orders in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

3. As a sequel thereto, the miscellaneous applications, if any,

pending in this Writ Petition shall stand closed. ________________________ A.
