HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7477 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondents to consider the claim of the petitioner on par with her juniors in the cadre of secondary grade teacher or alternatively to set aside the proceedings dated 24.05.1994 and 12.05.1995 issued by the then District Educational Officer, Hyderabad, by holding the action of the respondents in awarding the higher pay scales to the juniors of the petitioners and not extending the higher scale to the petitioner, as illegal and arbitrary. When the matter is taken up for hearing, it is brought to the notice of the Court by the learned counsel for the petitioner that the petitioner has attained the age of superannuation. If the petitioner is entitled for higher scale on par with her juniors, the same benefit has to be extended to her also. Therefore, this Court is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon within four weeks thereafter.
