THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.37283 OF 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondents 1, 2, 4 and 5.

The prayer sought in the writ petition is as under: "...............Writ of Mandamus, by declaring the action of the respondent No.4 to 7 in harassing the petitioner and his family members at the instigation of the 8th respondent as illegal, arbitrary and against the principles of natural justice and violative of Article 14, 19 and 21 of Constitution of India. Consequently, direct the respondent No.4 to 7 not to harass the petitioner and his family members by calling them to police station at the instigation of the 8th respondent and pass such other order or orders........."

During the course of hearing, learned Government Pleader appearing for respondents 1, 2, 4 and 5 placed on record, the written instructions issued by the Inspector of Police, II Town Police Station, Khammam.

A perusal of the said written instructions would reveal that one Smt.K.Sruthi-8th respondent herein approached II Town Police Station, Khammam and lodged a complaint stating that she has purchased the land admeasuring 975 sq.yards in Sy.No.149 from one Karnati Satyanarayana- petitioner herein on 09.06.2012 through an agreement. Later, the petitioner without informing the 8th respondent sold the said land to a builder by name Kamal for construction of apartments and thus she was

cheated by the petitioner. On the complaint made by her, G.D. entry was made vide Receipt No.1632 dated 20.10.2013. After going through the contents of the complaint, the respondent-police advised the 8th respondent and the petitioner to settle the dispute in the competent Civil Court, since the dispute is purely civil in nature. But no case whatever was registered on the file of II Town Police Station, Khammam till date.

As far as the allegation that at the instance of the 8th respondent, the petitioner is being summoned to the police station regularly and he and his family members are being harassed is absolutely false.

In view of the above said facts, this Court is of the opinion that no further cause would survive in the present writ petition. Accordingly, the writ petition is closed. No order as to costs.

Pending miscellaneous petitions, if any, shall also stand closed.
