THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5826 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.3 in Crime No.50 of 2021 on the file of Station House Officer, Medak Town Police Station, Medak District registered for the offence punishable under Section 20(b) of NDPS Act.

Heard learned counsel for the petitioner/Accused No.3 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that, the petitioner who is arrayed as Accused No.3 was arrested on the allegations of being involved in the ganja that was seized from Accused No.1 on 07.03.2021. Subsequent to the confession of Accused No.1, Accused No.2 was arrested and this petitioner/Accused No.3 was also arrested on 09.06.2022.

Learned counsel for the petitioner submits that Accused Nos.1 and 2 were already granted bail by this Court vide Crl.Petition Nos.4320 of 2021 and 2378 of 2022 respectively and prayed that since this petitioner was arrested consequent to the confession of Accused No.1 who was already released on bail, the same relief to be extended to this petitioner.

As seen from the record, both Accused Nos.1 and 2 were already released on bail, as such this petitioner can be granted the relief of bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.3 is granted bail subject to the following conditions:

i) The petitioner/Accused No.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of I Additional District and Sessions Judge at Medak.

ii) The petitioner/Accused No.3 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of three (03) months or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 12.07.2022 ns
