HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18466 OF 2018 O R D E R :

The case of the petitioner society is that the 4th respondent has issued orders leasing the fish wealth of subject pond for petitioner's enjoyment for the period from 01.07.2017 to 30.06.2018 and petitioner's society has also paid the lease amount as per the demand of the 4th respondent. While so, when the respondent Nos.6 and 7 started interfering with the fishing activities of the petitioner's society the petitioner's society made representation dated 28.04.2018 to the 4th respondent regarding the said interference. In pursuance of the same, the 4th respondent vide proceedings dated 08.03.2018, 30.04.2018 and 08.05.2018 instructed the respondents 2, 3 and 5 for providing police protection to the petitioner's society from the persons who are interfering and causing obstructions on the instigation of respondents 6 and 7.

Inspite of the said instructions issued by the 4th respondent the respondents are not providing any police protection to the petitioner's society from the persons who are interfering and causing obstructions on the instigation of the respondent Nos.6 and 7. Aggrieved by the same present writ petition is filed.

This Court on 11.06.2018 granted interim direction to the 3rd respondent to consider the representation of the petitioner dated 05.06.2018, in accordance with law.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner has never approached the respondent police at any point of time seeking police protection and if any such representation is received, necessary action will be taken.

In view of the above, it is open for the petitioner to make fresh application to the competent authority seeking police protection and on such application being made by the petitioner, the competent authority is directed to disposeof the same, in accordance with law and take action accordingly within a period of four weeks there on.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
