THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 11870 of 2002 ORDER:

This writ petition is filed seeking the following relief : " To issue a writ, order or direction particularly one in the nature of Writ of Mandamus declaring the action of the second and third respondents in discontinuing the services of the petitioners with effect from 27.12.2001 merely on the ground that the petitioners have failed in the second test ( i.e., interview) conducted on 23.10.2001 even without communicating the results of the first interview conducted on 20.7.2001 as arbitrary and illegal and consequently to hold that the petitioners are entitled for continuity of service and also deemed to have been placed on probation immediately after completion of six months of training and further hold that the petitioners are entitled for regularization of their services on regular basis with all consequential benefits."

When the matter is taken up for hearing, learned Standing Counsel for the respondents had informed to this Court that the cases of the petitioners were considered and they were subjected to the departmental tests and in the said tests, the petitioners could not come up within the zone of selection. Accordingly, the cases of the petitioners had not been considered for regularization. In view of the above submission of the learned Standing Counsel for the respondents, the writ petition is dismissed.

Miscellaneous petitions pending if any, shall stand closed. No costs.
