THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 20881 of 2011 Date: 19.06.2015 Between:

Kunwar Singh .... Petitioner And

1. The Commissioner of Police, Hyderabad Office at BasheerBagh, Hyderabad and others. ... Respondents

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 20881 of 2011 ORDER:

The grievance of the petitioner in this case was that the police authorities were not taking action in Crime No.95 of 2010 by laying a charge sheet though the interim order granted by this Court in Crl.P.No.5129 of 2010 had been vacated.

The learned Assistant Government Pleader for Home, relying on the written instructions dated 17.06.2015 received from the SubInspector of Police, Mangalhat Police Station, Hyderabad, informed this Court that pursuant to the private complaint made by the petitioner before the learned XVI Additional Chief Metropolitan Magistrate, Hyderabad, Crime No.95 of 2010 was registered under Sections 259, 263, 420 r/w 120-B IPC and Sections 465, 468 and 471 r/w 34 IPC. This crime was registered on the file of Mangalhat Police Station, Hyderabad on 17.05.2010 and investigation was taken up. Thereafter, an appropriate charge sheet was filed before the XVI Additional Chief Metropolitan Magistrate, Hyderabad, which was taken on file in C.C.No.600 of 2012. After a full dressed trial, the Court acquitted the accused by judgment dated 6.05.2015.

In the light of the aforestated facts, it is clear that the allegation of the petitioner as to the alleged inaction on the part of the police is without basis.

The writ petition is therefore dismissed.

Pending Miscellaneous Petitions shall also stand dismissed.

No order as to costs.
