THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.12 of 2014 ORDER:

Both respondents 1 and 2 are present in this Court. This Contempt Case is filed alleging violation of the order passed by this Court in W.P.No.20398 of 1999 dated 20.09.2012. Against the said order the first respondent carried the matter in appeal i.e. W.A.No.594 of 2013 and a Division Bench of this Court, by order dated 18.12.

2014, disposed of the said appeal directing that the first respondent-writ petitioner shall be deemed to have secured minimum qualifying marks for promotion to the post of MM-II for the year 1999; in case the punishment, that was awarded to him, did not disqualify him from being promoted, he should be deemed to have been promoted in the year 1999 and placed above the unofficial respondents in the Writ Petition; for this purpose it would open to the writ petitioner to make a representation and for the appellants to dispose of the same in accordance with law within a period of four weeks from the date of its submission. As the order of this Court in W.P.No.20398 of 1999 dated 20.09.

2012 has been modified in terms of what has been stated hereinabove, and the petitioner was permitted to submit a representation and the respondents-contemnors were directed to dispose of the same in accordance with law within a period of four weeks from the date of submission of the representation, the order passed in W.P.No.20398 of 1999 dated 20.09.2012 does not survive and, as such, the respondents cannot be said to have disobeyed the said orders much less wilfully and deliberately. The Contempt Case is, accordingly, closed. The miscellaneous petitions pending, if any, shall also stand closed.
