The petitioners pray for the following relief: "....
writ of mandamus, declaring the action of the respondents in trying to dispossess the authority verified and issued Pattadar Pass Book and entry the pahanies in the year 2005, we are cultivating in the said agricultural lands and standing crops are there in said (1) in survey No 1160 Extent of 0 98 Cents and Sy Nos 1162 Extent of Ac 3 00 Cents to total of Extent 3 Ac 98 Cents at Kanuparthi Village Nagulupalapadu Mandal Prakasam District (2) in survey No 1161 Ac 0 47 Cents and Sy Nos 1162 Extent of 2-53 cents total extent of Ac 3-00 cents at Kanuparthi Village Nagulupalapadu Mandal Prakasam District (3) in survey No 1162 Extent of 3-00 Cents and Sy Nos 1154 Extent of 1-00 cents total extent of Ac 4-00 Cents at Kanuparti Village Nagulupalapadu Mandal Prakasam District and (4) in survey No 1162 Extent of 2-87 Cents and Sy Nos 1161 Extent of 1-00 cents and Sy No 1197 Extent of 1-00 cents Total Extent of Ac 4-87 Cents at Kanuparthi Village Nagulupalapadu Mandal Prakasam District And consequently direct the respondents not to dispossess the petitioners without following due process of law ........."
The petitioners apprehend the dispossession by respondent No.4.
The Assistant Government Pleader submits that on mere apprehension, the writ petition ought not to be entertained at any rate. He further states that the respondents, if are desirous of taking subject matter
for any public purpose, the same ought to be in accordance with law.
This Court is of the view that on apprehensions expressed by the petitioners, the writ petition ought not to be entertained likewise, it is needless to observe that respondents ought not to interfere with the right of citizen except in the manner known to law.
Writ petition is dismissed with the above observation. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
