HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8422 OF 2017 ORDER:

The writ petition is filed challenging the demand notice dated 27.01.2017, issued by the 2nd respondent, on the ground that there was no assessment made before making the property tax demand. It is the contention of the learned counsel for the petitioners that the petitioners had already paid a sum of Rs.1,00,000/- as against the demand for a sum of Rs.4,04,746/-.

Learned standing counsel for the 2nd respondent corporation submits that the assessment would be made in accordance with the law. Considering the narrow controversy in issue, the writ petition is disposed of with a direction to the 2nd respondent to issue a fresh notice to the petitioner to make proper assessment in accordance with law and rules. However, subject the condition of petitioner depositing a further sum of Rs.1,00,000/- within a period of four weeks from today, the impugned order stands stayed. The amount which is directed to be paid and also the amount which has already been paid by the petitioner shall be subject to the final assessment orders that may be passed by the respondent authorities.

With the above observations, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any, in this writ petition shall stand closed.
