THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 42468 of 2015 ORDER:
The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner herein pray that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondents in interfering in civil dispute pending between the petitioners and respondent in respect of O.S.No.250/2014 and O.S.No.263/2014 on the file of the Senior Civil Judge, Allagadda and forcing the petitioners to withdraw the cases and settle the disputes with the respondent Nos.4 to 6 as arbitrary, illegal and consequently direct the respondents not to interfere in the civil dispute pending between the petitioners and respondent Nos.4 to 6 in respect of O.S.No.250/2014 and O.S.No.263/2014 on the file of the Senior Civil Judge Court, Allagadda in the interest of justice."
2. Interim orders were granted by this Court on 30.12.2015 directing the police authorities not to subject the petitioners to any harassment or interference in connection with the civil dispute with respondent Nos.4 to 6. The Sub-Inspector of Police, Allagadda Police Station filed a counter affidavit denying the allegation of the petitioners that there was any interference by the police authorities in the civil disputes of the petitioners with the unofficial respondents.
He specifically denied the allegation that the petitioners were summoned to the police station and directed to withdraw the civil suits and compromise the matter. He further denied the allegation that there was any threat held out to the petitioners that they would be implicated in false cases if they did not withdraw the cases.
He asserted that he had never interfered in any civil disputes between the petitioners and the unofficial respondents.
3. In the light of the aforestated unrebutted stand taken by the police authorities in the counter affidavit, which is duly taken on record, no adjudication is warranted in this writ petition. The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
