HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.854 OF 2013 JUDGMENT:

Since there was no representation for the appellant on 13-06-2017, the Registry was directed to list the matter under the caption "for dismissal." Thereafter, at request of the learned counsel for the appellant, the matter was adjourned on two occasions i.e., 15.06.2017 and 22.06.2017. Despite the same and also listing the matter under the caption "for dismissal", today again there is no representation for the appellant.

Therefore, the Second Appeal is dismissed for non-prosecution, at the admission stage itself. There shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in the S.A. stand closed.
