No.142 4 of 2017 on the file of the Hon'ble Additional Judicial First Class Magistrate, Karimnagar, arising out of Crime No. 72 of 2016 registered under Sections 420 and 406 lpC. This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Mr. Rakesh Jangem, Advocate for the Petitioners and the Mr. Jithender Rao Veeramalla, Additional Public Prosecutor on behalf of the Respondent No.1 and None Appeared for the Respondent No.2.

THE HONOURABLE SRIJUSTICE N. TUKARAMJI CRIMINAL PETITIO N No.8760 ot 2025 ORDER:
This petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short'the BNSS') seeking quashment of the proceedings in C.C.No.1424 of 2017 pending on the file of the learned Additional Judicial First Class Magistrate, Karimnagar, against the petitioners/accused Nos.1 and 2.
2. I have heard Mr.Rakesh Jangem, learned counsel for the petitioners, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.'l-State.
3. The petitioners are arrayed as accused Nos.1 and 2 in C.C.No.'|424 oI 2017 facing accusation under Sections 42O and 406 of lndian Penal Code.

Having considered the submissions advanced by the petitioners, I \ this Court takes note that the Petitioner No.1/Accused No.1 is willing to face the proceedings, subject to the Petitioner No.1 appearing through his counsel on every date of hearing, and ensuring his physical appearance before the trial court as and when specifically directed, the requirement of his personal attendance in proceedings pertaining to C.C. No. 1424 of 2017, pending before the learned Additional Judicial First Class t
Magistrate, Karimnagar, is hereby dispensed with. lt is further clarified that any failure on the part of Petitioner No.1 to comply with the conditions set forth herein shall render this order inoperative 5.
ln regard to the Petitioner No.2, considering the pleading that his name has been incorrectly recorded and that a Non-Bailable Warrant (NBW) remains pending against him. Accordingly, liberty is granted to Petitioner No.2 to appear before the trial court and file an appropriate application, (i) explaining the discrepancy or inaccuracy in the spelling of his name; and (ii) seeking recall of the Non-Bailable Warrant issued against him. Upon the filing of such an application, the trial court is directed to consider the same on its own merits and to pass appropriate orders in accordance with law.
