THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5851 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 and 2 in Crime No.579 of 2022 on the file of Station House Officer, Miyapur Police Station, Cyberabad registered for the offences punishable under Sections 498-A and 306 of Indian Penal Code. 2.

Heard learned counsel for the petitioners/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the petitioners 1 and 2 are son and mother who are arrested on the allegation of abetting suicide of the wife of the 1st petitioner. It is the case that the 1st petitioner and the deceased were married on 28.07.2012 and at the time of marriage the de facto complainant who is the mother of the deceased gave dowry of Rs.3,20,000/- and 10 tulas of gold. Subsequently, the petitioners started harassing the deceased

physically and mentally for additional dowry. Ultimately unable to bear the harassment, the wife of the 1st petitioner committed suicide on 06.05.2022. Aggrieved by the same, the mother of the deceased filed the present complaint alleging that these petitioners are responsible for the death of her daughter who were constantly harassing her for additional dowry.

As seen from the allegations made in the complaint, certain allegations are made regarding additional dowry without giving any specific details, since the petitioners are in jail since 07.05.2022, these petitioners/Accused Nos.1 and 2 can be granted the relief of bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 and 2 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.1 and 2 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of VIII Additional Metropolitan Magistrate at Kukatpally.

ii) The petitioners/Accused Nos.1 and 2 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or until filing of charge sheet whichever is earlier.

iii) The petitioners/Accused Nos.1 and 2 shall not in any manner contact either the de facto complainant or her family members, failing which the prosecution is at liberty to move for cancellation of bail granted to these petitioners/Accused Nos.1 and 2. iv) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
