HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22980 OF 2002 ORDER :

This Writ Petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not providing compassionate appointment to the petitioner under the Bread Winner Scheme to the post of Conductor Grade-II, in spite of conducting interview on 16.06.2001 as per call letter dated 2.6.2001 as illegal, arbitrary and sought a consequential direction to the respondents to provide compassionate appointment.

Heard Mr.K.R.Srinivas, Counsel for the petitioner and Mr.S.V.Ramana, Standing Counsel for the respondents.

It has been contended by the petitioner that his father was appointed as Driver in APSRTC during the year 1987 and his father expired on 29.08.2000, while discharging his duties. In those set of circumstances, the petitioner has applied for compassionate appointment under the Bread Winner Scheme and the petitioner was also interviewed. But the respondents have not considered his case for compassionate appointment.

The Standing Counsel for the respondents contends that at this point of time considering the case of the petitioner would not arise. 5.

This court having heard the rival submissions made by the parties is of the view that the Writ Petition can be disposed of directing the respondents to consider the case of the petitioner for compassionate appointment in accordance with the rules and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

With this observation, Writ Petition is disposed of.
