THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION NO.4449 OF 2015 ORDER:

Heard the learned counsel appearing for the petitioners.

2. This Civil Revision Petition is directed against the order, dated 11-032015 in C.M.A.No.25 of 2012 on the file of the III Additional District and Sessions Judge, SPSR Nellore District, confirming the injunction order granted by the learned Senior Civil Judge, Kovvur, dated 13-04-2012 in I.A.No.167 of 2011 in O.S.No.51 of 2011.

3. I have perused the order under revision. Though the learned counsel appearing for the revision petitioners tried to persuade this Court by referring to a few improbabilities recorded by the learned III Additional District Judge, Nellore, I am satisfied that the objections raised by the learned counsel for the petitioners are not tenable and do not attract the jurisdiction of this Court. The issue between the parties and the available material are considered by the 1st appellate Court and with cogent findings dismissed the Civil Miscellaneous Appeal. Absolutely, there are no grounds to interfere with the impugned order.

4. Accordingly, the Civil Revision Petition is dismissed. Since the suit is of the year 2011, the learned Senior Civil Judge, Kovvur, is directed to dispose of O.S.No.51 of 2011 as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any pending in this revision shall stand closed.
