THE HON'BLE SRI JUSTICE S.V. BHATT COMPANY APPLICATION No. 675 of 2016 IN COMPANY PETITION No.71 of 2014 ORDER:

This application is filed under Section 456 and 457 (1) (c) (e) of the Companies Act, 1956 read with Rule 9 of the Companies (Court) Rules, 1959 (for short 'the Rules').

The Official Liquidator prays for the following relief: "(i) to permit the Official Liquidator to ascertain the intending buyers by publication of a small classified advertisement in Eenadu of Ranga Reddy District Edition and through reliable sources who ever participated earlier, to sell the current year i.e. (2016) mango crop situated at the Company's land to an extnt of Ac.59.09 Gts. in Sy.No.69 to 96 part/full at Tolkatta village, Moinabad Mandal, Ranga Reddy District or as may be directed by this Hon'ble Court.

(ii) permit the Official Liquidator to receive the entire crop amount who offering the highest amount and to allow the highest offerer to take the mango crop of the current season (2016) at an appropriate period Or as may be directed by this Hon'ble Court.

(iii) order the cost of this application to come out of the assets of the company."

2. The harvesting season of mango crop since commences immediately, this Court is of the view that the Official Liquidator is directed to undertake Tom Tom of the proposed auction on or before 07.05.2016, authorize one of the staff members to go and conduct auction at the subject mango garden and file report by the next date of hearing.
