HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO C.C.C.A. No.111 of 2013 JUDGMENT:
Pending appeal, the appellant/plaintiff and respondent/ defendant are present and filed CCCA MP No.627 of 2015 under Order 23 Rule 3 C.P.C to dispose of the appeal in terms of compromise along with memorandum of compromise and joint memo.
2) As per memorandum of compromise, the respondent/ defendant is a tenant originally of the ground floor shifted to first floor, and ground floor in the occupation of appellant/ plaintiff-owner having received an amount of Rs.80,000/- as consideration and handed over the premises i.e., first floor by saying that he is no way concerned with the first floor and second floor that belongs to appellant/ plaintiff and the same agreed as the terms of compromise arrived at.
3) Having regard to the same, the compromise is recorded and the appeal is decreed in term of compromise, so no execution is necessary by recording full satisfaction of the decree as compromise stated already and delivered possession.
4) Accordingly, the appeal is disposed of. No costs.
5) Consequently, miscellaneous petitions pending if any, in this appeal shall stand closed.
