THE HON'BLE SRI JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE T.AMARNATH GOUD I.A.No.4 of 2018 In/And C.M.A.No.714 of 2018 COMMON JUDGMENT: (Per the Hon'ble Sri Justice Raghvendra Singh Chauhan) The appellant, Ms. Anusha Reddy Singareddy, is present before this Court. In order to establish her identify, she has submitted her Aadhaar Card. She has also been identified by her counsel, Mr.M.Vijaya Kanth. Similarly, the respondent, Sri Gade Ashok Reddy, is also present before this Court. He has also submitted his Aadhaar Card in order to prove his identity. He, too, has been identified by his counsel, Mr. Gadi Praveen Kumar.

The appellant-wife has challenged the legality of the order dated 17.04.2018, in Divorce O.P.No.617 of 2015, passed by the Principal District Judge, Warangal, whereby divorce was granted in favour of the respondent-husband. However, during the pendency of the present appeal, both the parties have entered into a compromise, and have settled their disputes outside the Court. They have submitted a memorandum of compromise, which shall be taken on record.

The terms of the compromise are as under:

In pursuance of the understanding between both the parties, the Respondent has agreed to pay total amount of Rs.20,00,000/- (Rupees Twenty Lakhs Only) as full and final settlement to the Petitioner through Four (4) Demand Drafts bearing No.1. DD.No.545065 SBI JNTU, Hyderabad for an amount of Rs.4,00,000/- (2) DD.No.504398 from ICICI Bank, Warangal for an amount of Rs.4,90,000/- (3) DD.No.028992 from HDFC Bank, Nakkalagutta, Warangal for an amount of Rs.4,00,000/- and (4) DD.No.028991, HDFC Bank, Nakkalagutta, Warangal for an amount of Rs.3,10,000/- including Rs.4,00,000/- in cash totalling to Rs.20,00,000/- and also One long Necklace, Chain, 2 rings and 2 ear rings totalling to 8 1⁄2 Tulas of Gold in favour of the petitioner which will be handed over to the petitioner at the time of recording compromise before the Hon'ble Court.

The Respondent agreed for the above terms and conditions and both the parties shall not interfere with the personal and private life of

each other in future. Both the parties shall co-operative with each other till the compromise and also closing of all the cases from the Hon'ble Court and thereafter the spouses would be at liberty to settle their respective lives and contact marriages of their choice. 6.

The Petitioner hereby declare that, she will not make any claim for maintenance, permanent alimony or for property against the Respondent in future either personally or legally and even if any of such claims are made, it shall be deemed that they are non-est and unenforceable. The appellant also declare that she has no other claim against the Respondent. Further the appellant and the respondent are hereby releasing and relinquishing all their rights against each other from the date of recording this compromise and passing of the orders of this Hon'ble Court. Further it is specifically agreed that both the spouses should not file any criminal or civil cases in future against each other and if any other cases are pending the respective parties has to withdraw the same immediately after presenting this Memorandum of Compromise."

Therefore, the appeal is allowed in terms of the compromise and I.A.No.4 of 2018 is ordered. Registry is directed to pass the decree in terms of the compromise. There shall be no order as to costs.
