This Civil Revision Petition is filed under Section 115 of CPC, by the petitioner/ defendant, aggrieved by the order dated 13.09.2019 passed in E.P.No.631 of 2019 by the learned V Senior Civil Judge, City Civil Court, Hyderabad, whereby the Court below issued delivery warrant against the Judgment Debtor. 2) Heard the learned counsel for the revision petitioner, learned counsel for the respondents and perused the record. 3) It is evident from the record that there is no suspension of the judgment and decree dated 06.06.2019 passed in O.S.No.1099 of 2016 by the learned V Senior Civil Judge, City Civil Court, Hyderabad.

4) In the course of submissions, it is brought to the notice of this Court that challenging the aforesaid judgment and decree dated 06.06.2019 an appeal was filed before the District Court concerned and the same is pending. In the given circumstances, it is for the appellate Court to take a decision and pass appropriate orders. There are no merits in the C.R.P and the same is liable to be dismissed.

5) Accordingly, the Civil Revision Petition is dismissed. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
