This contempt case is filed alleging that in spite of the directions issued by this Court to respondent No.4 in the writ petition not to make any further construction of compound wall and direction to respondent No.3 in the writ petition to ensure that no further construction is made by respondent No.4, construction activity is going on and the same would be amounting to violating the directions of this Court.

In the counter affidavit, the Commissioner deposed that pursuant to the interim orders, notice under Section 636 of the Greater Hyderabad Municipal Corporations Act, 1955 was issued and notice was also issued to respondent No.4 in the writ petition not to undertake further construction and prosecution was also launched against him. It is further averred that C.C.No.2570 of 2019 is pending in the Court of I Additional Judicial First Class Magistrate, Warangal, on the complaint lodged by the petitioner by the Municipal Corporation against unauthorized and illegal construction. It is also stated that demolition work was taken up in compliance of the directions issued by this Court. However, in the meantime, respondent No.4 in the writ petition filed W.P.No.24294 of 2019 and by order dated 05.11.2019, this Court directed maintenance of status quo and therefore no further action could be taken.

Having regard to the averments made in the counter affidavit, there is no violation of the directions issued, more so

- 3 - willful and deliberate warranting initiation of contempt proceedings.

The contempt case is accordingly closed.
