HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.8973 of 2009 ORDER :

The petitioner complains against the inaction of 1st respondent in disposing of stay petition filed by petitioner on 20th of April 2009 filed along with revision questioning the orders dated 05.03.2009 and 14.06.2008 as illegal and arbitrary.

The prayer is one of inaction in considering a stay petition said to have been filed by the petitioner in the year 2009. Neither the petitioner nor the Assistant Government Pleader is in a position to place before the Court the latest position in the revision filed by the petitioner. This Court is not inclined to consider the grievance of inaction at this point of time. The writ petition is dismissed. However, the petitioner is given liberty to avail the remedy against the final order, if any, passed by 1st respondent in the revision referred to above.

With the above observation, the writ petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
