THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39232 OF 2015 O R D E R :

Heard counsel for the petitioners and the Government Pleader for Revenue appearing for the respondents.

2. Petitioners' grievance is that they are the owners of various plots purchased under registered sale deeds bearing Nos.1834 to 1945 of 2010 in Survey No.47 of Mudhavadhara Village of Visakhapatnam; that they intended to sell the said plots to some third parties; but the 2nd respondent is not receiving the documents for the purpose of registration.

3. The Government Pleader for Revenue appearing for respondents states that the 2nd respondent would receive the documents presented by the petitioners and if he does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said documents.

4. In view of the said submission, the Writ Petition is disposed of directing the 2nd respondent to receive the documents presented by the petitioners, and if the 2nd respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks from the date of presentation of documents by the petitioners and communicate his decision thereon to the petitioners. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
