HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13732 of 2017 ORDER:
The Writ Petition is filed questioning the inaction of respondent No.1 - Municipality, in taking action against respondent Nos.2 and 3, pursuant to the complaint dated 06.03.2017 despite revocation of permission to respondent Nos.2 and 3 on 04.03.2017 and 03.03.2017 respectively, as being illegal and arbitrary.
Petitioner - School states that respondents Nos.2 and 3, who claim to be purchasers of land belonging to School, had obtained construction permission misrepresenting facts and, pursuant to their complaint, respondent No.1 revoked permission to respondent Nos.2 and 3 on 04.03.2017 and 03.03.2017 respectively. The grievance of the petitioner - School is that, though permission was revoked by respondent No.1 - Municipality, construction work is being carried on by respondent Nos.2 and 3. Hence the Writ Petition.
Sri Nimmagadda Venkateswarlu, learned Standing Counsel for respondent No.1, on instructions, would submit that, if any, illegal constructions are being carried on, necessary action would be taken by the respondents in accordance with law.
In the circumstances, Writ Petition is disposed of with a direction to respondent No.1 - Municipality to consider the complaint of the petitioner and, if any illegal
constructions are found, take action in accordance with law.
Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
