HON'BLE SRI JUSTICE J. SREENIVAS RAO Writ Petition No. 18271 of 2005 ORDER:- Heard Sri Kowturu Pavan Kumar, learned counsel for the petitioners and Sri V.Satyam Reddy counsel for respondent No.3 and V.Uma Devi, Learned Standing Counsel for the respondent No.1 and 2.

2. The learned counsel for the petitioners contended that the respondent Corporation without properly considering the claim of the petitioners for appointment under compassionate grounds rejected the same and issued impugned Proceedings dated 22.03.2005 and the same is contrary to law.

3. The learned standing counsel for the respondents contended that the respondent corporation after examining the representations submitted by the petitioners passed the impugned order by giving cogent reason holding that the petitioners are not eligible for compassionate appointment and they have not fulfilled the prerequisite conditions.

4. This Court, having considered the rival submissions made by the parties, is of the considered view that as per the scheme introduced by the respondent Corporation through BPMS No.119 dated 10.02.1982 and BPMS No.258 dated 26.08.2004 respectively, the case

of the petitioners does not fall within the definition of dependent and they are not entitled to claim appointment under compassionate grounds. The respondent Corporation has rightly rejected the claim of the petitioners through impugned proceedings dated 22.03.2005 and there is no illegality or irregularity in the impugned orders. The writ petition is devoid of merits and the same is liable to be dismissed.

5. Accordingly, the writ petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
