This petition is filed, seeking for quash of the proceedings against the petitioner, who is the accused, in Crime No.86 of 2013 of Gandhinagar Police Station, Secunderabad. The offences alleged against the petitioner are under Sections 186 and 506 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

The allegations in the complaint are that the petitioner went to the police station and abused the complainant on the ground that he did not take any action on the complaint, which was given by one Swaroopa.

The counsel for the petitioner submits that when no action was taken on the complaint given by one Swaroopa, the petitioner went to the police station to enquire about the same and the complainant beat the petitioner and he was also admitted in the hospital. He also files medical certificate pertaining to Aditi ENT, head & neck clinic, wherein it was mentioned that the petitioner was beaten by the Sub-Inspector of Police, Gandhinagar Police Station, when he was pleading with the CI regarding the attempt to commit suicide by Swaroopa.

From the above, it appears that the complaint is filed with false allegations. Hence, this court opines that the further proceedings against the petitioner would only result in abuse of process of law.

Accordingly, the Criminal Petition is allowed and the proceedings against the petitioner, who is the accused, in Crime No.86 of 2013 of Gandhinagar Police Station, Secunderabad, shall stand quashed.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
