THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.37356 of 2014 ORDER:

The case of the petitioner is that he is the owner of land to an extent of Ac.1.03 guntas in survey No.59 correlated to T.S.No.10/4, Block No.E, Ward No.171 of Saidabad Village and Mandal, Ranga Reddy District. It is alleged that the property is said to be ancestral property and on partition, the same has been fell to the petitioner's share.

He made an application, dated 13.09.2013, to the Deputy Director of Survey and Land Records, Hyderabad, the 3rd respondent herein, seeking survey and demarcation of the land. He had also paid necessary amounts as required under the rules. The grievance of the petitioner is that the respondents did not act on the application as yet. Hence, this writ petition.

When the matter came up for admission on 06.12.2014, this Court directed that appropriate action shall be taken on the application of the petitioner to conduct the survey, if not already conducted, expeditiously.

Today, learned Assistant Government Pleader for Revenue, on instructions, submits that the survey could not be conducted by the 3rd respondent, on account of the confusion that the extent of land in the affidavit has been mentioned as Acs.7.00, whereas the survey is being sought only against Ac.1.03 guntas. He, however, submits that if two weeks time is granted, the 3rd respondent would complete the survey.

Recording the submission made by the learned Assistant Government Pleader and treating it as an undertaking from the

3rd respondent that he shall conduct the survey within two weeks from today, the writ petition is disposed of. Further, it is made clear that direction given by this Court for conducting survey shall not be construed as expressing any opinion with respect to the ownership and title of the petitioner in any manner in respect to the land in question. There shall be no order as to costs. The miscellaneous petitions filed in this writ petition shall also stand disposed of.
