HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6213 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in D.V.C.No.66 of 2019 on the file of the II Additional Judicial Magistrate of First Class, Khammam. 2.

A charge sheet came to be filed against the petitioners for the offences punishable under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

Though the present Criminal Petition is filed seeking to quash the entire proceedings in the aforesaid D.V.C, learned counsel for the petitioners restricts his prayer to seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment. 4.

The learned Public Prosecutor submits that since the identity of petitioners is not in dispute, their presence in the above D.V.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners in D.V.C.No.66 of 2019 on the file of the II Additional Judicial Magistrate of First Class, Khammam, is hereby dispensed with except on the dates when their presence is specifically required by the Court. The petitioners shall be represented by their counsel before the Court below.

With the above direction, the Criminal Petition is disposed of. 7.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
