THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12163 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-Accused No.1 under Section 438 Cr.P.C. seeking to grant anticipatory bail to her in FIR No.893 of 2015 on the file of Panjagutta Police Station, Hyderabad, registered for the offence punishable under Sections 420, 467 and 471 IPC.

Heard and perused the material available on record. It is alleged that the petitioner has been running office of Manpower Consultancy in the name of "Trend Employment", without obtaining valid licence and that the petitioner is collecting huge amounts by promising that she will send the aspirants to abroad. The petitioner used to prepare and enclose fake and fabricated letters, certificates to the applications of the aspirants for getting VISA. Further, it is alleged that a petition has been received by the complainant from one Murali Mohan Challa, which was addressed to High Command Brunei, Darussalam on 10.2.2014. In the said petition, the said Murali Mohan stated as follows:

"With reference to my mail and attached documents, I am an aspirant of overseas job and I have been informed by my consultant viz., Trend employments that I have been selected and waiting for contact letter and visa. But in the attachments as the reference number is not mentioned, I feel it suspicious, so contacting you for guidance. Please give me the information of below attached files as to whether they are genuine or not. Basing on the said complaint, the High Command Brunei, Darussalam caused enquiry and reported it as "I am forwarding the mail apprehended below from one Mr. Murali Mohan Challa and an attachment, taking the letter head and the signature of this High Commission. The letter contains various names stating that their visa applications for Brunei have been verified. It is clearly a ploy to cheat the persons mentioned in the attachment. Therefore, it is requested to take necessary action against the concerned of Trend Employments overseas Manpower and Education Consultants".

The complaint clearly indicates that the petitioner along with other persons is

collecting money and creating fake documents as they are providing job to various persons.

Considering the facts and circumstances of the case and the nature of the allegations made in the complaint, this Court is not inclined to grant anticipatory bail to the petitioner.
