HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6166 of 2019 O R D E R :

This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.249 of 2017 on the file of II Additional Chief Metropolitan Magistrate, Hyderabad. charge sheet came to be filed against the petitioner/A.4 and others for the offences punishable under Sections 406, 420, 506 r/w. Section 34 of IPC. Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioner, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, personal appearance of the petitioner/A.4 in C.C.No.249 of 2017 on the file of II Additional Chief Metropolitan Magistrate, Hyderabad, is hereby dispensed with while permitting him to mark his appearance through his counsel,

GSD, J Crl.P.No.6166 of 2019 except on the dates when his presence is specifically required by the said Court.

With the above direction, this Criminal Petition is disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
