HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39141 OF 2016 ORDER:
The action of the 3rd and 4th respondents in trying to dispossess the 1st and 2nd petitioners from land in survey No.63 admeasuring Acs.2-29 cents, 3rd petitioner from land in survey No.63 admeasuring Acs.3-21 cents, petitioners 4 to 6 from land in survey No.60/C1 admeasuring Ac.0.02 cents situated in Kanakadinne Village, Pattikonda Mandal, Kurnool District, without issuing any notice, is the subject matter of challenge in this writ petition.
Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
Learned counsel for the petitioners submits that though the petitioners were assigned the subject lands in the year 2004, without following due process of law, the 3rd and 4th respondents are trying to dispossess the petitioners from the subject lands without canceling the assignments.
Learned AGP would submit that no action would be taken by the respondents without following due process of law. Recording the statement made by the learned AGP, the Writ Petition is disposed of directing respondents 3 and 4 not to
dispossess the petitioners from the subject lands without following due process of law, if the petitioners are in possession of the land. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
